This outlines the Terms and Conditions under which Mabini Express Inc. offers you access to this website, which allows you (the Sender) to transmit money on-line to a designated beneficiary (Recipient) in the Philippines, for disbursement. These Terms are effective as of June 1, 2013 and are binding as between the Sender and Mabini Express Inc. Mabini Express Inc. may update the terms and conditions without notice to you, by posting the updated Terms on this website. If you do not agree to be bound by the Terms please do not access or use our service for on-line remittances. By accessing and using the service of on-line money remittance, you are agreeing to these Terms. 


This service is an electronic, Internet-based service in which remittance transactions are conducted, recorded and tracked. Therefore, you understand and agree that this Agreement will be entered into electronically, and that, in accordance with applicable law, the following categories of information may be provided by electronic means: 

* These Terms and Conditions, and any amendments, modifications or supplements to it.

* Your payment records, transaction records, transaction tracking and e-mail confirmations of each individual transaction.

* Any initial, periodic or other disclosures or notices provided in connection with the on-line remittance transaction, including without limitation those required by applicable law. This may include verification of information provided by you to the Bank to ensure that all Payment requests are compliant with applicable laws and regulations.

* Any customer service communications, including without limitation communications with respect to claims of error or unauthorized Use of the Service.

* Any other communication related to the use of our website.

Although Mabini Express Inc. reserves the right to provide Communications in paper format at any time, you agree that we are under no obligation to do so. All Communications in either electronic or paper format will be considered to be "in writing" and in accordance with applicable law. You should print a paper copy of these Terms and any electronic Communication that is important to you and retain the copy for your records. 

Delivery of Electronic Communications

Subject to applicable law, Communications between the user and Mabini Express Inc. may be posted within the website or other websites disclosed to you and/or delivered to the e-mail address you provide. All electronic Communications will be deemed to have been received by you no later than forty eight (48) hours after Mabini Express Inc. sends it to you by e-mail or posts the Communication on the website, whether or not you have received the e-mail or retrieved the Communication from the website. You agree that these are reasonable procedures for sending and receiving electronic Communications.

You agree to promptly update your records and personal profile if your e-mail address or other information changes. 


You may send money remittance through our website to be picked up by a designated Beneficiary at an Agent location or deposited to the Beneficiary’s bank account, or loaded onto a BDO Cash Card. Money Remittances will be paid to the Beneficiary in cash, Manager’s Check, BDO Cash Card, or a combination thereof, subject to currency availability and the conditions applicable to the selected payment location. Dollar amounts of money remittance transactions that exceed certain principal amounts may take longer or be subject to additional restrictions. The sender must provide Mabini Express Inc, with valid government issued picture identification and a copy of the form of payment used before a transaction will be released. Mabini Express Inc. has the discretion to request additional documentation to verify the Sender’s identity, and to disapprove a transaction if it cannot satisfactorily verify Sender’s identity and payment information. The Beneficiary must present a valid form of government issued picture identification in accordance with Mabini Express Inc. policies. Sender and Beneficiary represent, warrant and certify to Mabini Express Inc. that their Use of the on-line money remittance shall not in any way, directly or indirectly, (a) violate any law, statute, ordinance, contract or regulation, including but not limited to any law, statute, ordinance, contract or regulation relating to money laundering, illegal gambling activities, support for terrorist activities, fraud or theft, and/or (b) violate any of the Terms of Use. Mabini Express Inc. may, at its discretion, freeze any transaction that appears to be suspicious and withhold related funds until Mabini Express Inc. determines the transaction to be legitimate. When required by applicable law, money remittance transactions will be reported to federal, state, local or foreign authorities. In addition, Mabini Express Inc. will cooperate with law enforcement in the prosecution of illegal activities to the fullest extent permitted by applicable law. You will be required to provide Mabini Express Inc. with certain information to allow us, among other things: to verify your identity; to receive appropriate bank card authorization; and to complete the transaction. You agree that the information provided is not false, inaccurate or misleading. 

Upon registration a form will be presented requesting the Sender’s name, address, Driver’s License number, and other information, which will help us identify the Sender.

We will be comparing the Sender information provided to information contained in the Sender’s consumer report. Mabini Express Inc. will only use the information in your consumer report for the purpose of validating your identity and no other.

If we are unable to validate your identity through the on-line process, you will be directed to an alternative, off-line process. Provided that we are able to validate your identity in this alternative, off-line process you will be able to enjoy on-line all that we have to offer.

By accessing and using the service of on-line money remittance, you agree to the use of your credit report for the purpose of validation of your identity and for no other purpose.

Mabini Express Inc. will take due diligence measures to validate your identity during your registration process and every two years from the date of your registration or at any time in its sole discretion.

Funding Your Money Transfer

You initiate a money transfer by entering the required information requested and agreeing to these Terms. There is currently one way you can make a Payment:

Interac Online 

You can send a money remittance by using a valid bank account and by entering the required account information and authorization information. The name and address of record on the bank account you use to pay for the money transfer must be the same as the name and mailing address you furnish when you register for the Service. Failure to comply with such requirement may result in cancellation or delay of your money remittance transaction. Entering a deposit account number constitutes your authorization for Mabini Express Inc, to debit the amount you enter on this website, plus any applicable fees as set forth in these Terms. 

Money transfers may not be initiated by check, cash or wire transfer. 


Mabini Express Inc. is adamant in protecting consumer privacy. To help the government fight the funding of terrorism and money laundering activities, Federal law requires financial institutions and their third parties to obtain, verify, and record information to identify you. To be able to accurately identify you, you will be asked for your name, address, date of birth, and other related information.



Mabini Express Inc. does not permit our website and on-line remittance transactions to be used for improper, unlawful, or fraudulent transactions ("Unauthorized Transactions"). Unauthorized Transactions include but are not limited to attempts (a) to remit funds Using stolen, unauthorized, or otherwise compromised debit card, or bank account, (b) to transfer funds Using an account with insufficient funds (c) to seek reimbursement of funds that have already been disbursed, (d) to launder funds, (e) to fund terrorist organizations, and (f) to violate local, state, or federal laws of Canada, laws of the Destination Country, Territory, international laws, or the laws of any other relevant jurisdiction. Any incidents of Unauthorized Transactions are subject to prosecution to the full extent of the law. International Beneficiaries of funds acquired through Unauthorized Transactions may also be subject to civil penalties and/or criminal prosecution in their country of residence including, but not limited to, the repossession of the total funds delivered and received as a result of an Unauthorized Transaction. 


REFUNDS OF PRINCIPAL AMOUNT and cancellation of the money transfer will be made upon written request by you if payment to the Beneficiary has not yet been made at the time the request is processed by Mabini Express Inc. Refunds will be made within thirty (30) days of receipt of a valid written request from the Sender. DISPUTES OR CLAIMS RELATIVE TO ANY TRANSACTION ENTERED INTO WITH MABINI EXPRESS INC. SHALL BE DEEMED WAIVED IF FILED AFTER SIX (6) MONTHS FROM DATE OF TRANSACTION. 


Mabini Express Inc. reserves the right to limit the principal amount of a money transfer, or to reject a proposed money transfer, in its sole discretion. Mabini Express Inc. assumes no obligation to make payment of the money transfer or to complete the applicable money transfer transaction if Mabini Express Inc. does not receive authorization from the bank card issuer or depository institution, nor does Mabini Express Inc. assume any liability for damages resulting from nonpayment of the money transfer or any failure to complete any applicable Service transaction by reason of such lack of authorization. Mabini Express Inc. reserves the right to refuse to provide the Services to You, at any time, for any reason deemed necessary to protect Our interests.

Mabini Express Inc. shall not be liable for any interruption of service due to causes beyond its control, including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the money remittance; acts of God; acts of public authorities acting with actual or apparent authority; insufficient information provided by a customer; the application of security regulations imposed by the government, or otherwise applicable to the delivery location; riots, strikes, or other labor disputes; civil commotions; disruptions in ground transportation networks, such as weather phenomena; and natural disasters. 


You are responsible for all authorized uses of the Service as accessed by your name and password. Applicable law may protect you from liability for unauthorized use. An "Unauthorized" use is use of the Service by someone other than either yourself or someone authorized by you. A transaction is not Unauthorized if: (1) You give your password or checking account information to another person expressly or implicitly authorized to use the service and that person uses the service; or (2) for any reason Mabini Express Inc. concludes that the facts do not reasonably support a claim of Unauthorized Use. 



Mabini Express Inc. website, the Mabini Express services, the content, and all intellectual property pertaining thereto and contained therein (including but not limited to patents, database rights, text, graphics, links, buttons, logos, images, copyrights, trademarks and service marks) are owned exclusively by Mabini Express Inc., and all right, title and interest therein and thereto shall remain the property of Mabini Express Inc. Mabini Express Inc. website and contents be used only for the purpose permitted by these Terms. You are authorized solely to view and retain a copy of the pages of Mabini Express Inc. website for your own personal, non-commercial use. You agree that you may not duplicate, publish, modify, create derivative works from, participate in the transfer of, post on the World Wide Web, or in any way distribute or exploit Mabini Express Inc. website, or any portion thereof for any public or commercial use without the express written consent of Mabini Express Inc. You further agree not to: (i) Use any robot, spider, scraper or other automated device to access the Mabini Express Inc. website and/or Service; and (ii) remove or alter any author, trademark or other proprietary notice or legend displayed on the Mabini Express Inc. website (or printed pages thereof). The name Mabini Express Inc. and other names and indicia of ownership of Mabini Express Inc.’s Service are the exclusive marks of Mabini Express Inc. Other product, service and company names appearing on the website may be trademarks of their respective owners. 


Entire Agreement -- These Terms embody the entire agreement and understanding between you and Mabini Express Inc. and supersede all prior agreements or understandings you have with Mabini Express Inc. If any one or more of these Terms shall for any reason be held to be invalid, illegal or unenforceable, the remaining provisions shall remain valid and enforceable and the parties nevertheless agree that an arbitrator or court should endeavor to give appropriately valid effect to the intention of these. Your access to and use of the Mabini Express Inc. website and Service is governed by Canadian Law. Mabini Express Inc. website and Service are directed to persons age 18 and over residing in the Canada. Mabini Express Inc. website and service are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.

Modification -- These Terms may be modified or amended by Mabini Express Inc. from time to time without notice, except as may be required by law. You can review the most current version of the Terms at any time by reviewing this website. You may terminate your use of the Service if you do not agree with any modification or amendment. If you use the Service after the effective date of an amendment or modification, you will be deemed to have accepted that amendment or modification. You agree that you will not modify these Terms and acknowledge that any attempts by you to modify these Terms shall be void.

Mabini Express Inc. is adamant in protecting consumer privacy. Currently, this information concerning your privacy is only applicable to online transactions initiated by Canadian customers and visitors to our website. 
Mabini Express Inc. limits access to your personal information to those employees of Mabini Express Inc. and its affiliates who need it to fulfill their business responsibilities. Employees must adhere to Mabini Express Inc. privacy policies. Employees violating these policies may be subject to disciplinary action, up to and including dismissal. Vendors and other outside contractors engaged with Mabini Express Inc. are subject to our contractual requirements to ensure that your sensitive personal information is safeguarded. We employ appropriate measures to protect your information against unauthorized access, disclosure, alteration or destruction. These may include, among others, encryption, physical access security and other appropriate technologies. Mabini Express Inc. continually reviews and enhances its security systems, as necessary. 
COLLECTION OF INFORMATION: Mabini Express Inc. collects personal and non-personal information in order to offer or provide you the ability to send on-line remittance transactions. We may obtain this information from a variety of sources including, but not limited to the following: (a) directly from customer applications, questionnaires and other materials submitted to us by the Sender; (b) from transactions in which Mabini Express Inc. and sender are involved; (c) from clickstream activity on our website (including the use of “cookies” and or “web beacons,” as discussed below); and (d) from a variety of third-party sources, such as government repositories, consumer reporting agencies and other financial institutions. 
USE OF COOKIES AND WEB BEACONS: A "cookie" is a small text file placed on your computer's hard drive by a web server and which is acknowledged by your web browser. "Web beacons" are transparent electronic images placed in the web code, also called "clear GIFs" or "Web bugs." We use cookies and/or web beacons for a variety of purposes, including, but not limited to, the following: (a) to assist us in providing you our services; (b) to allow you to change pages during your visit to our website without repeatedly having to re-enter your password; (c) to track activity on our website; or (d) to determine whether you came to our site from a banner ad or an affiliate website. There are some disclosures to third parties that are not subject to the opt-out, such as the following: disclosures necessary to effect, administer or enforce a transaction requested by you, to companies that perform services for us, to prevent fraud; and, in addition, Mabini Express Inc. may disclose information about former consumers or customers to third parties and companies with which Mabini Express Inc. is affiliated. Those disclosures may consist of the following: (a) financial background information describing financial status; (b) identification information, such as name and address data; (c) transaction information, such as account activity and (d) other information relating to financial matters. 
RECIPIENTS OF INFORMATION: Mabini Express Inc. may disclose your information to companies affiliated with us. These recipients include: (a) financial institutions such as banks (b) companies that process transactions or provide other services for us including, but not limited to, attorneys, accountants, and auditors; and (c) government and law enforcement agencies in general and where specifically required or permitted under the Privacy Act to comply with federal, state, or local laws, rules, and other applicable legal requirements
